General Terms and Conditions for participation in the competition of Metzgerei Freyberger KG (“Organizer”) and the participating customer (“Participant”)
1. Subject of the Conditions of Participation and Organizer
These terms and conditions regulate the conditions for participation in the competition and any necessary transfer of rights. The description and process of the respective competition will take place as part of the respective competition campaign on the organizer's social media platforms. The organizer of the competition is Metzgerei Freyberger KG, Sperberstraße 99, 90461 Nuremberg.
By participating in the respective competition, you accept these terms and conditions.
2nd participation
Participation in the competition from Metzgerei Freyberger KG, hereinafter referred to as the organizer, is free of charge and is subject exclusively to these terms and conditions. In order to take part in the competition, you must participate online. You must leave a comment under the organizer's competition video with the content of either naming the best/funniest gift you received or gave away on Father's Day and adding the caption "#UnityForFrey".
Participation is only possible within the participation period. Entries received after the closing date will not be considered in the draw.
Participation in the competition is from 01.05.24 5:00 p.m. to 06.05.24 11:59 p.m. During this period, users will have the opportunity to take part in the competition.
Natural persons who are resident in Germany and are 18 years or older are eligible to participate. Participation is not restricted to customers of the organizer and is not dependent on the purchase of a product or service. If a participant has limited legal capacity, the consent of his or her legal representative is required.
Participation with false identities or with identities of third parties is not permitted.
Only one submitted entry per participant will take part in the competition. It is strictly forbidden to use multiple addresses or profiles to increase your chances of winning.
In addition, the organizer reserves the right to exclude persons from participation at its own discretion if there are legitimate reasons. Such reasons include in particular:
- Manipulation in connection with access to or implementation of the competition
- violations of these conditions of participation
- unfair dealing or
- false or misleading information in connection with participation in
- the competition.
- If the excluded participant is already
- drawn winner, the prize can be revoked retroactively.
3. Prizes, prize notification and delivery of prizes
We will raffle off the following prizes among all eligible participants:
1x Unity XL from Keter (1st place)
1x Go Bar by Keter (2nd place)
The winners will be determined within 2 weeks of the closing date of the competition in a random draw or by the organizer's selection from among all participants, subject to the conditions already mentioned. If the competition is linked to a task, only those participants who have completed the task correctly will be entered into the draw.
The participants who are winners of the raffle will be informed of their win promptly by the organizer via a message on one of the social media channels. Further conditions for contact and verification will be set.
The prize will be handed over exclusively to the participant who has won.
An exchange, transfer or cash payment of the prize is not possible.
The prizes must be collected by the winner. Any shipping costs are to be borne by the winner.
The risk is transferred to the participant when the prize is handed over to a transport person. The organizer is not responsible for delivery damage. Additional costs associated with claiming the prize are borne by the participant who has won. The participant who has won is responsible for any taxation of the prize. If the participant who has won does not respond after being asked twice within a period of 3 weeks, the right to the prize expires. In this case, the organizer is entitled to hold a replacement draw and then transfer the prize to another participant. Only one prize is possible per participant. If circumstances arise for which the organizer is not responsible, the respective participant who has won will accept an appropriate replacement prize. Such circumstances for which the organizer is not responsible include in particular those that are the responsibility of the sponsors of the prizes.
4. Termination of the competition
The organizer reserves the right to terminate the competition prematurely, in whole or in part, or to change its course at any time, even without observing deadlines and without prior notice and without stating reasons, if it is not possible to guarantee the proper and scheduled execution of the competition for technical reasons (e.g. computer virus, manipulation of or errors in software/hardware) or legal reasons.
5. Data Protection
To participate in the competition, you must provide personal information (first and last name, email and postal address, telephone number, date of birth). The participant assures that the personal information he or she provides, in particular first and last name, email address, postal address and date of birth, is true and correct.
The organizer is responsible for the collection, processing and use of participants' personal data. The organizer will only use the participant's personal information and other personal data within the framework of the statutory provisions of data protection law. The organizer points out that all of the participant's personal data will not be passed on to third parties or made available to them for use without consent.
The organizer will only store, process and use the information to the extent that this is necessary for the conduct of the competition or if the participant has given their consent.
6. Applicable Law
Questions and complaints in connection with the competition should be directed to the organizer. The organizer's competition is subject exclusively to the laws of the Federal Republic of Germany. Legal recourse is excluded.
7. Severability Clause
Should a provision of these terms and conditions of participation be or become invalid in whole or in part, this shall not affect the validity of the remaining provisions of these terms and conditions of participation. Instead of the invalid provision, the legally permissible provision shall apply which economically comes closest to the meaning and purpose expressed in the invalid provision. The same applies if there is a regulatory gap in these terms and conditions of participation.
